Mariwan Halabjaee,* "the Salman Rushdie of Iraqi Kurdistan," is the author of the book "Sex, Sharia and Women in the History of Islam." The book is about how Islam and Sharia law are allegedly used to oppress Muslim women. "I wanted to prove how oppressed women are in Islam and that they have no rights," said Mr. Halabjaee. "My book is based on Islamic sources such as the Holly Quran, Muslim and Bukhari books and many more."
Mr. Halabjaee was forced to flee to Norway from Iraqi Kurdistan because the Islamic League of Kurdistan issued a "conditional" fatwa to kill him if he did not repent and apologize for writing his book. The "conditional" nature of the fatal fatwa was uncertain at best. Mr. Halabjaee reported, "the mullahs and scholars said if I go to them and apologize they will give me 80 lashes and then refer me to the fatwa committee to decide if I am to be beheaded. They might forgive me, they might not."
Mr. Halabjaee received telephone calls saying, "Now, in 10 years or 15 years, we will kill you." Another time, Mr. Halabjaee reported, "the Islamists said once from the radio, if they found out where I was, they would blow themselves up with me." The worst thing was realizing his wife and children were in danger. "With that book I wanted to defend women but the first thing I did was hurt my wife." As a result, Mr. Halabjaee went into hiding with his pregnant wife and three children.
Mr. Halabjaee fled Iraqi Kurdistan after the Kurdistan Regional Government (KRG) refused to offer him any protection or to arrest those who threatened his life. "The Kurdish authorities have not provided any protection from threats and fatwas," said Mr. Halabjaee, "any moment I am expecting a bullet or a hand grenade to be thrown into where I live."
In response to the Halabjaee affair, the KRG Minister of Religious Issues, Dr. Mohammad Gaznayi, told protestors that according to the law of Iraqi Kurdistan, "defamation" or "criticizing" religion or religious figures is a crime and its punishment is severe. "We will give those who attack our prophets a sentence so that they can be a lesson for everyone," said Dr. Gaznayi. [Dr. Gaznayi is the same KRG Minister of Religious Issues who said, "I consider that those who turn to Christianity pose a threat to society."] Mr. Halabjaee was in possession of a warrant for his arrest issued by the Suleimaniya police department when he fled Iraqi Kurdistan.
In August 2006, Mr. Halabjaee was granted political asylum in Norway.
In December 2007, Mr. Halabjaee was convicted in absentia in Iraqi Kurdistan for the crime of blasphemy. A court in Halabja sentenced Mr. Halabjaee to six months in prison for writing that the prophet Mohammed had 19 wives, married a 9-year-old when he was 54 years old, and committed murder and rape. Mr. Halabjaee remains in hiding in Norway. The sentence states that he will be arrested upon his return to Iraqi Kurdistan.

But arrogance can go to the head of even good people who have tasted too much success. And this leads me to question the wisdom of an Islamic state.

A large part of the explanation has to do with the fact that there are radical Imams who have obtained somewhat prominent status within the British Muslim Community. How this has happened is illustrated by the Dispatches videos seen here:

Of particular concern is Abu Usamah who implied that the Imam at the head of an Islamic theocracy would have the right to kill homosexuals if he thought that this would please Allah.

At 3:58 of part 2, Abu Usamah states that the Imam of an Islamic state has the right to implement what Allah commanded him in the Koran.

In part 3 he calls homosexuality a major sin—but that homosexuals are under Allah's decision. If Allah wants to punish them he will. If he doesn't it's up to him.... He cited an Islamic scholar who looked at the way Allah's angel destroyed Saddam and Gomorah and concluded that the appropriate way to kill homosexuals was to throw them off a mountain.
But since they live in Great Britain, it is not the Muslim's place to take the law into their own hands and start killing gays.
Question: If Muslim's grow strong enough to replace England's government with a theorcracy, would the Imam, the leader of the state, have the right to have gays thrown from a mountain? What safeguards would there be against this? What safeguards would there be against killing people who drink booze? dress inappropriately, etc.?
If Allah doesn't want people thinking like this, why didn't he put an FAQ at the front of the Koran informing them of his wishes? Why isn't the Koran idiot-proof? Couldn't Allah have made it idiot-proof? Or are there limitations on His power. If he could have made it idiot-proof, then why did he refrain from doing so? Does he enjoy the fact that many people (both Muslim and non-Muslim) misunderstand His true intentions?
And if someone as decent as the SwordofAllah can become cocky with just a few debating wins under his belt, what can we expect from the head of an Islamic State who thinks his rule is backed by Allah? Might he not grow cocky and arrogant? Might he not misinterpret the Koran and order the deaths of those who he thinks Allah disapproves of? Even if one could find a wise and just Imam to lead an Islamic state, what will happen when he dies? Could we expect a long succession of just and wise men, or is it not likely that a bad apple will come to power? In short, will there be a set of checks and balances under Sharia law?
Perhaps the versions of Sharia law that exist in Iran and Saudi Arabia are an anathema to Allah. But He could have done such a good job that EVERYONE would know what His intentions were and there would be no misunderstandings—at least He could have if He had infinite powers..
And if the fault lies not in the Koran, but in our human inability to understand the Koran, then He could have made us all a bit smarter and wiser.
