Manitobans could be the first Canadians to face jail time and fines for failing to report suspected cases of child pornography. - CBC News has learned the provincial government will introduce legislation Wednesday that will amend the Child and Family Services Act to expand the definition of child abuse to include child pornography. - Under the legislation, anyone caught not reporting suspected cases of child pornography could face up to two years behind bars or a maximum $50,000 fine - the same penalty for those who fail to report child abuse. - "Child porn is not just a picture - it's a sexual assault committed against a child," said Lianna McDonald, director of the Canadian Centre for Child Protection. "It's an act of child abuse that needs to be stopped." - The agency runs the national tip line for reporting child sexual exploitation that Manitobans will be asked to call if they notice a possible case of child pornography. - McDonald said the legislation won't solely target internet service providers, but everyone from computer repair technicians to a babysitter who stumbles upon photos in someone's home. - Police outside Manitoba are applauding the move, including Toronto's police force, which is known worldwide for employing innovative methods of cracking down on sexual exploitation. - "These are real children and these are real photos and we can never forget that.... It's evidence and should be treated that way," said Det.-Sgt. Kim Scanlan, who heads the Toronto Police Service's child exploitation unit. - Child protection advocates said they hope the federal government will adopt legislation similar to the Manitoba proposal. A Managed Service Company (MSC) is a form of intermediary company which enables workers to provide their services to end clients. The definition of an MSC in the legislation includes both 'composites' and 'managed personal service companies'. A provider promotes the use of such companies and offers the structure. The worker is a shareholder, but does not have any control over the company. What does the MSC legislation do? It deems any payments received by an individual working through an MSC to be employment income. This means that PAYE and Class 1 NICs must be applied to all income received by individuals in MSCs in relation to their services. The legislation applies whatever the form through which the worker receives their remuneration. What does the MSC legislation do? If an MSC cannot pay the PAYE and NICs that it is liable for, under the MSC legislation the debt can be transferred to a third party, including the company's director, the MSC provider and, in certain circumstances, other third parties that may have benefited from the placement. The key parts of the legislation took effect from 6th April 2007 and in August 2007 the Finance Bill was formally enacted, meaning the full legislation, including transfer of debt provisions, is now in force. When is an MSC not an MSC? A number of MSC Providers have been telling their clients that they are accountants rather than MSC Providers in response to the legislation, leading individuals to believe that they are not affected by the MSC Legislation. HM Revenue & Customs actually still views many of these organisations as MSC Providers. The relationship between the client's company and the MSC Provider is what will determine whether the new tax rules apply or not. Individuals who have continued to operate through such service companies need to carefully consider their relationship with the MSC Provider. If the service company is within the legislation, and has not operated on a PAYE basis, the individual could be held personally liable for the debts. Who is affected? Who isn't? Who is affected? Primarily it is the workers who use Managed Service Companies to provide their services, because the legislation is concerning taxation of that person's income. The legislation also affects anyone who makes Managed Service Companies available (MSC Providers). In certain circumstances, the legislation may also affect other third parties. Who is affected? Who isn't? Who is not affected? Workers operating through a Personal Service Company that is not within the new definition of a MSC. Workers operating through Umbrella Companies. Cardozo School of Law, Yeshiva University - Jacob Burns Moot Court Room, New York, New York It is estimated that one in five boys and one in four girls in America are victims of childhood sexual abuse. Most of the perpetrators are known by the victims. But, far too many of these crimes go unreported for many years -- only 10 percent of victims go to authorities -- and most of the offenders escape responsibility. When victims finally -- and courageously -- speak up, they are denied justice as arbitrary statutes of limitations prohibit them from seeking legal recourse. Two states -- California in 2003 and Delaware in 2007, led by Sen. Peterson -- have enacted legislation that amends these arbitrary deadlines to enable both criminal prosecutions and civil actions against the perpetrators. In California, "window" legislation, which suspended the civil limitation, helped identify 300 previously anonymous predators and enabled victims to seek justice again them. For the past several years, Assemblywoman Markey has introduced similar legislation in New York. It has passed in the Assembly, but has stalled each time in the Senate. **************** September 24, 2007 To: Members of the Media From: "America's Most Wanted" Since the show's inception in 1988, America's Most Wanted has captured more than 950 fugitives, helping thousands of victims worldwide get justice. But justice isn't always possible for everyone. "One of biggest frustrations for us," says program host John Walsh, "is working on cases where the victims in some states will likely never see justice. Because each state in this country has its on criminal laws, often the statute of limitations precludes victims from ever seeing their attackers pay the price for their crimes." In New York State, for example, sexual assault cases have a statute of limitations of 10 years, which hardly seems acceptable given that the national collection of DNA evidence is a relatively new initiative and it often takes years and years to get a match or a "hit" on a particular criminal's DNA. John Walsh references a recent case profiled on AMW: A man named Altemio Sanchez was wanted for a number of rapes and a number of murders in Buffalo, New York. The fugitive was eventually captured and has since been sentenced to prison for the three murders. However, even though DNA evidence linked Sanchez to more than a dozen rapes, none of those victims will ever get closure because the statute of limitations had run out. "It's time for Statute of Limitations laws to catch up with the 21st century," said John Walsh. "Only then, will victims of crime have a true opportunity to seek and receive justice," he said.
