'Legal challenge to declare court order which barred Bersih activists and public from Monday Parliament null and void
I have filed an application in the Kuala Lumpur High Court to challenge the legality of the court order obtained by the police barring Bersih activists and the public from Parliament on Monday, 11th December 2007 as null and void.
Karpal Singh is assisted by M. Kulasegaran in preparing the writ of summons in the case Lim Kit Siang vs OCPD Sentul, Inspector-General of Police and the Malaysian Government. My statement of claim, filed with the Kuala Lumpur High Court yesterday, follows:
STATEMENT OF CLAIM
1. The plaintiff is a Malaysian citizen of age and at all material times, Opposition leader, Dewan Rakyat and Member of Parliament (Ipoh Timur).
2. The first defendant is the OCPD, Sentul.
3. The second defendant is the Inspector General of Police.
4. The third defendant is the Government of Malaysia and the plaintiff pleads that at all material times, the first and second defendants were the agents and/or servants of the third defendant which is vicariously liable for the acts and/or omissions of the first and second defendants.
5. The plaintiff pleads that at the commencement of the 11th Parliament in May 2004, the following motion was unanimously approved by the Dewan Rakyat:-
"Bahawa Majlis ini memerintahkan Ketua Polis Negara menjaga supaya selama Penggal Dewan Rakyat yang ada sekarang, jalan-jalan melalui lorong-lorong menuju ke Dewan ini hendaklah senantiasa terbuka dan boleh dilalui dan jangan ada apa-apa halangan menghalang ahli-ahli hendak pergi dan balik dari Dewan ini, jangan berlaku apa-apa kacau-bilau di jalan-jalan menuju ke Dewan ini, dan supaya jangan ada huru-hara di Bangunan Dewan ini dan berhampiran dengan bangunan ini; dan Setiausaha Dewan Rakyat hendaklah menyampaikan perintah ini kepada Ketua Polis Negara yang tersebut itu." ('the said directive of the Dewan Rakyat')
6. The plaintiff pleads by the said directive of the Dewan Rakyat, the second defendant was required by law to ensure, inter alia, all police personnel in his command were prohibited from in any way causing a disturbance within the precincts of the Dewan Rakyat.

Police arrested Mustafa Ali within Parliament compound this morning, without any court order.
The unparliamentary police action could be seen as 'invading' the Parliament and utter contempt of the sanctity of the Parliament.

'YouTube video of police roughing up and dragging away veteran PAS leader who was former Deputy Minister and MP, Mustapha Ali when effecting arrest at Parliament precincts yesterday - another damning evidence of the violation of the sanctity of Parliament by the police and executive.
I told the police that what they had done was just wrong. DAP MP for Ipoh Barat, M. Kulasegaran asked where was the court order justifying the police action, but the police refused to show such an order.
Mustapha was guest of PAS MP for Tumpat, Kamaruddin Jaffar but such niceties and courtesies mean nothing to the Police, as clearly shown by this video clip captured by Lim Swee Kuan.

11 December 2007, the darkest day of Malaysian Parliament.
It is outrageous and I am in a state of utter disbelief at what I have seen. The Parliament is the symbol of democracy, but the police has infringed the integrity and dignity of Parliament by 'invading' into the Parliament to arrest the peaceful petitioners.
The four petitioners involved were Pusat Komas programme director Mien Lor, Suaram executive director Yap Swee Seng, Centre for Independent Journalism executive director V Gayathry and Writers Alliance for Media Independence chairperson Wong Chin Huat.
The activists were earlier seen being taken away by about five plainclothes police officers while leaving Parliament House after handing the Bersih memorandum to opposition Parliamentarians, to be given to Prime Minister Abdullah Ahmad Badawi.

What was their crime? For upholding the Malaysian Constitution for wanting to have free and fair elections?
Writers Alliance for Media Independence chairperson Wong Chin Huat held up the Constitution and sang Negaraku when he was arrested by the Police in Parliament yesterday to tell the world that he committed no crime except for his love for the country and to protect and promote the Malaysian Constitution.

Also arrested at the same time as Chin Huat were Suaram executive director Yap Swee Seng, Centre for Independent Journalism executive director V Gayathry (both on YouTube) and Pusat Komas programme director Mien Lor.
DAP MPs Chong Eng (Bukit Mertajam), Fong Kui Lun (Bukit Bintang), M. Kulasegaran (Ipoh Barat), Chow Kon Yeow (Tanjong), Fong Pokuan (Batu Gajah), Lim Hock Seng (Bagan), Chong Chien Jen (Bandar Kuching) and I were taking the four for lunch outside Parliament when the police swooped and intercepted them while in parliamentary precincts as if they were "top villains" of the country!

KOTA BHARU, 27 Nov (Hrkh)- Persidangan kali ketiga (Belanjawan) bagi tempoh penggal ke empat Dewan Undangan Negeri Kelantan mencatat sejarah terburuk apabila Dato' Nozula Mat Diah(BN-Paloh) bertindak menendang Mohd Zaki Ibrahim(PAS- Kelaboran) sewaktu sesi soal jawab dalam sidang DUN semalam.
Kejadian memalukan itu berjaya dirakamkan selama hampir dua minit dan aksi biadapnya boleh ditonton oleh semua pihak di laman web yang sentiasa menyiarkan perkembangan secara langsung Sidang Dun Kelantan.
Insiden bermula apabila Dato' Mohd Zain Ismail (BN-Bukit Tuku) tidak berpuas hati dengan jawapan yang diberikan oleh Pengerusi Jawatankuasa Perdagangan, Perindustrian dan Sumber Manusia , Zulkifli Mamat terhadap soalan yang dikemukakannya mengenai perkembangan projek Afta City Rantau Panjang bahawa projek tersebut telah dibatalkan.
"Permasalahan sekarang ialah kerajaan ingin memperbetulkan kenyataan bahawa ada exco yang hadir dalam perasmian tersebut. Kita ingin memperbetulkan kenyataan yang menyebabkan tuduhan daripada pihak YB (BN).
"Kita tidak mahu YB yang dipilih,kutip bawa cerita tepi jalan dan bawa naik ke dewan. Adakah hendak perbetulkan ini salah, "kata Zulkifli yang diikuti ketukan di meja oleh beberapa Adun.
Nozula tendang Zaki
Kata-kata Zulkifli itu menimbulkan kemarahan Nozula yang bangun dan menyifatkan jawapan Zulkifli itu sebagai 'tidak cerdik' dan menganggap pihak kerajaan negeri menuduh pihak pembangkang bodoh dan tidak mempedulikan teguran speaker supaya beliau duduk.
Keadaan menjadi semakin panas apabila Nozula mengambil serius kata-kata usikan daripada Zaki Ibrahim yang menimbulkan kemarahannya.
"Bagi peluang aku keccek lepas ni,"kata Nozula dengan nada yang keras.
Kata-kata Zaki supaya Adun Paloh itu meminta maaf kepada dewan dan meyatakan beliau bersikap kurang ajar menyebabkan Nozula bertindak diluar jangkaan.
"Mu yang kurang ajar," katanya sambil bertindak menyerang Zaki.
Tindakan Nozula itu cuba dihalang oleh beberapa Adun termasuk Saufi Deraman(BN-Galas) dan Abdul Halim Abdul Rahman(PAS- Chetok) yang berada bersebelahan Zaki.
Walaupun dihalang Nozula sempat melepaskan tendangan terhadap Zaki. Suasana dewan menjadi sedikit kecoh dan terpaksa ditenangkan oleh Speaker.
Sebelum ini, pada persidangan Dun 21 November, Nozula digantung sementara daripada menyertai persidangan pada hari tersebut yang mana Speaker menggunakan peraturan 51(3) bagi menggantung anggota Dewan Negeri yang enggan mematuhi arahan dan melakukan tindakan melampau-lampau semasa permesyuaratan berlangsung.

A Barisan Nasional MP departed from the norm today when he said the rally organised by the Hindu Rights Action Force (Hindraf) reflected the Indian community's disgruntlement towards certain government policies.
YB K.Devamany (MIC-Cameron Highlands) added that the rally proved the failure of government policies which do not benefit the Indians.
The ruling politician made the remark after interjecting Parliamentary Opposition Leader YB Lim Kit Siang (DAP-Ipoh Timor) who argued that the rally was 'a cry of desperation' from the Indians.
"Some 50,000 people took to the streets yesterday. It shows the government's failure and it needs to be looked into carefully," said Devamany.
Meanwhile, Lim stood up and told Devamany not to be a hypocrite by practising double standards.
He was referring to Devamany's interview with satellite station Al-Jazeera yesterday, in which he condemned the rally.
"Devamany should publicly apologise for his Al-Jazeera interview yesterday belittling the Hindraf demonstration and condemning the demonstrators when he should be deploring the police mishandling and excessive use of force in firing tear gas and liquid chemicals against the defenceless and unarmed in Kuala Lumpur yesterday", said Kit Siang in his statement today.
In the Al-Jazeera interview, Devamany joined the chorus of Barisan Nasional leaders in running down the Hindraf demonstration, condemning it as irresponsible with bad intention, making derogatory reference to the "type of people" who came to join the demonstration.
"As if they were the riff-raff and good-for-nothings when they in fact represented a fair cross-section of the Malaysian Indian community from all over the country, including professionals and among the most idealistic men and women for whom the Malaysian Indian community and the Malaysian nation have every reason to feel proud," said Kit Siang.

After confering a new title 'Minister of Mis-information' to Information Minister Zainuddin Maidin two days ago, Parliamentary Opposition Leader YB Lim Kit Siang (DAP-Ipoh Timur) today once again gave the RTM (Radio Televisyen Malaysia) a new name - RT'BN' (Radio Televisyen Barisan Nasional).
The issue started when Kit Siang and another Deputy Information Minister Chia Kwang Chye (BN-Bukit Bendera) debated on the role and responsibilities of RTM in news reporting, in which was seen as giving a very biased coverage of news.
RTM was found guilty of not reporting the facts and exact number of people who had attended the BERSIH rally last Saturday.
Kit Siang stressed that the state-owned television station RTM should report the truth and give a 'free and fair' coverage to all news because it is ran by the taxpayers' money.
"RTM is not television station of BN. It is not RT'BN', but RTM - Radio Televisyen Malaysia!"
